Defendant was found guilty of conspiracy to commit wire fraud, wire fraud, and mail fraud for his actions as the owner and chief executive officer of a telemarketing company that sold limited indemnity healthcare insurance plans over the phone. On appeal, defendant sought to vacate his conviction on numerous grounds, including the district court’s instruction to the jury on the term “scheme to defraud,” and the provision of an exhibit to the jury during deliberations.
