In re Marriage of Raine

In a dissolution of marriage matter, respondent appealed from a trial court order granting the petitioner’s amended turnover request and directing the respondent to transfer all funds held in an annuity account in an escrow account. The issue raised on appeal was whether the trial court erred in determining that the annuity account was subject to a turnover for the payment of maintenance arrearages and interest in light of a statutory exception under the Withholding for Support Act. The appellate court affirmed the trial court, finding that while an individual retirement account was exempt from judgment a statutory exception exists for maintenance and child support.
