In a bankruptcy matter, the trustee asked the Seventh Circuit whether a bankruptcy court’s time saving “plan forward” procedures, in which the court approves a bankruptcy plan before a creditor has filed a claim, violates the United States Bankruptcy Code. The Seventh Circuit affirmed the district court and the bankruptcy court, concluding that a creditor is entitled to receive distributions as directed by the terms of a confirmed Chapter 13 plan notwithstanding whether the creditor filed a proof of claim.
