Mechanics Lien Act
The appellate court considered whether under the Mechanics Lien Act the filing of an amended complaint filed after the initial complaint is dismissed with leave to amend restarts the five-month deadline to substitute a surety bond in place of a lien. The appellate court held that it did not, explaining that the petition to substitute a bond must be filed within five months of the earliest pleading in which the lien claim is raised.
