Federal 7th Circuit Court
Civil Court
Eighth Amendment
Plaintiff, an inmate in a state correctional facility, filed a lawsuit alleging that corrections officers violated his Eighth Amendment rights during transport from the correctional facility to an outside hospital. The district court granted summary judgment for the officers, finding that they were entitled to qualified immunity. The Seventh Circuit affirmed in part, vacated in part, and remanded, finding that the district court erred in awarding one officer qualified immunity at summary judgment but affirmed the district court’s judgment as to two other officers.
