Sovereign Immunity
Plaintiff, a former Illinois State Police dispatcher, alleged that her employer violated the Genetic Information Privacy Act by requiring her to disclose genetic information as a condition of employment. The trial court dismissed the complaint and plaintiff appealed. On appeal, the appellate court considered whether the Act waived the State’s sovereign immunity from monetary damages. The appellate court affirmed, finding that the Act did not contain an express waiver of sovereign immunity for damages. (PUCINSKI and GAMRATH, concurring)
