Wrongful Death
Plaintiff, as independent administrator of the estate of a deceased individual, filed a lawsuit for survival and wrongful death arising out of a multiple vehicle collision on the interstate. Plaintiff settled with several co-defendants and proceeded to trial against a suburban delivery service as well as the driver of the delivery vehicle. The jury entered a verdict for the plaintiff and defendants appealed. On appeal, defendants argued that numerous errors warranted entry of judgment notwithstanding the verdict or a new trial. The appellate court affirmed, finding that the trial court did not err in the admission of evidence or rulings made during trial. (VAN TINE and ELLIS, concurring)
