Plaintiff filed a lawsuit for personal injuries he sustained when using a water slide that was closed after the water park’s manager told plaintiff that he would not object to plaintiff’s group using the slide. The district court dismissed the complaint and plaintiff appealed. The Seventh Circuit vacated the judgment and remanded for further proceedings, finding that while it agreed with the district court’s conclusion that plaintiff was a trespasser on the slide, a jury could also find that defendant acted recklessly.
