Plaintiff filed an action for unpaid rent and eviction, and the trial court entered judgment against the defendants, who were not allowed to participate in the trial for failing to appear or to enter an appearance. The trial court later found service was improper as to all three defendants but found that one of the defendants had waived service by “participating” in the case because he had appeared at a status hearing, but without having filed an appearance. The appellate court vacated the underlying judgment against that defendant, finding that he did not waive service of process by showing up to court on the status hearings.
