Line-of-Duty Disability
Plaintiff was injured while working as a firefighter/paramedic and he sought a disability pension. Following an administrative hearing the board awarded plaintiff a line-of-duty disability pension based on a firefighter’s salary. Plaintiff asked the board to reconsider, arguing that it had miscalculated his pensionable salary. Specifically, he argued that his pension should have been based on a lieutenant’s salary because he obtained that rank during his recovery, but the board denied the request. The appellate court agreed with plaintiff and reversed and remanded for a redetermination of plaintiff’s permissible salary. (SCHOSTOK and BIRKETT, concurring)
