Illinois Appellate Court
Civil Court
Standing
Plaintiffs filed a class action lawsuit against defendants following a data breach, which compromised personally identifying information and personal health information alleging claims of negligence, negligence per se, breach of fiduciary duty, breach of implied contract, unjust enrichment, and violations of the Consumer Fraud and Deceptive Business Practices Act. The circuit court granted defendants’ motion to dismiss by finding that the plaintiffs’ lacked standing because the alleged harms were speculative and conclusory, not imminent and substantial and the appellate court affirmed.
