Dist. Ct. did not err in dismissing for failure to state cause of action under California law instant action alleging that defendant made certain unduly optimistic statements about defendant's entity that caused plaintiff to hold, rather than sell his stock in said entity. Plaintiff failed to establish that any earlier disclosure of true facts about entity would have enabled him to sell his stock before dropping of stock's price.
