Federal 7th Circuit Court
Criminal Court
Sentencing
Dist. Ct. did not err in sentencing defendant to 96-month term of incarceration on wire and mail fraud charges arising out of scheme to sell counterfeit fine art prints of well-known artists, where said sentence was based in part on Dist. Ct.’s finding that said scheme involved over $1,000,000 in loss to victims of scheme. Loss figure was supported by record where defendant admitted to purchasing $500,000 in counterfeit artwork for one of several dealers and then marking up such artwork before selling to customers. Dist. Ct. also did not err in imposing $316,425.65 restitution order based on invoices that recorded individual sales of artwork to victims, as well as other reports from customers regarding what they had paid for said artwork.
