The federal Telephone Consumer Protection Act of 1991 ("TCPA"), prohibiting "junk faxes", forms part of the law enforceable in Illinois courts. Thus, the Illinois legislature is not required to enact enabling legislation for Illinois state courts to hear and enforce private TCPA claims.
