(Modified upon denial of rehearing 4/23/12.) Defendant was convicted, after bench trial, of resisting a peace officer, based on her complete refusal to be either photographed or fingerprinted during booking process. Regardless of whether Defendant committed a physical act, her refusal actually obstructed officers in completing booking process, which is essential element of offense of resisting a peace officer.
