Unemployment Compensation
Plaintiff filed for administrative review of decision of IDES denying unemployment benefits, based on finding that she was discharged for misconduct connected with her work due to attendance issues. Illinois Unemployment Insurance Act does not require that reason for discharge must by solely misconduct to be disqualified for unemployment benefits. Finding of misconduct requires proof: 1) of deliberate and willful violation of employer's rule or policy; 2 )that rule or policy was reasonable; and 3) that violation either harmed employer or was repeated by employee despite previous warning or explicit instruction from employer. (J. GORDON and HOWSE, concurring.)
