Court properly granted summary judgment for two Defendant physicians, as Plaintiff failed to raise factual question as to hospital "holding out" physicians as employees or agents. Consent for treatment form signed by Plaintiff stated clearly and concisely that no physicians at hospital are its employees or agents but are independent contractors. Party has a duty to read consent for treatment form prior to signing it, and that Plaintiff was in pain when signing does not excuse him from this duty. (HYMAN and PIERCE, concurring.)
