Ineffective Assistance of Counsel
Defendant was convicted, after jury trial, of first-degree murder and aggravated battery with a firearm. Court properly summarily dismissed Defendant's postconviction petition as frivolous and patently without merit. Efforts to quash Defendant's arrest would have been futile, as testimony of trial witnesses and police reports show that police had probable cause to arrest Defendant before transporting him to the station. Police detention of Defendant at scene of shooting for 45 minutes was reasonable, and his arrest was supported by probable cause. Thus, no ineffective assistance of counsel.
