Accountability Theory
After stipulated bench trial, Defendant was convicted of unlawful delivery of a controlled substance (heroin) under accountability theory. Defendant was proved guilty of offense by accountability theory beyond a reasonable doubt, and Defendant knowingly and voluntarily waived his right to jury trial. Police investigation revealed that Defendant was involved in arranging the heroin purchase between victim, age 29, who died of heroin overdose and Defendant's roommate, who sold victim the heroin.
