Illinois Appellate Court
Civil Court
Medical Malpractice
Plaintiff filed medical malpractice suit against physician, and jury entered verdict for physician. Court did not abuse its discretion in granting Defendant's motion in limine and barring testimony from Plaintiff's expert that Defendant's chart was missing a page, as there would have been little, if any, probative value to expert's testimony. Plaintiff failed to show that he was prejudiced by court's refusal to give jury instruction or verdict form that addressed contributory negligence, as such instruction would have only reduced damages Plaintiff would have been awarded had he prevailed. (CONNORS and HARRIS, concurring.)
