This case presents question as to whether defendant’s conviction on charge of aggravated unlawful use of weapon (AUUW) based upon defendant’s carrying of loaded firearm at time when he was not in his own home or place of business violated defendant’s Second Amendment right to bear arms? Appellate Court, in upholding conviction, found that AUUW did not violate defendant’s right to bear arms, that amended AUUW, which took effect on August 29, 2009 and permitted carrying of loaded gun on another individual’s property as invitee, did not apply retroactively to instant charge, and that even if amended statute applied, defendant’s conviction would still stand.
