Breach of Contract
Contractual dispute between 2 orthodontists. Contract provided that in the event that Defendant finds cause to involuntarily disassociate Plaintiff from the Company's dental practice, Defendant shall give written notice to Plaintiff of said involuntary disassociation decision. The term "cause" in contract requires a higher standard that that typically used in employment context. Contract requires Defendant to possess more than a subjective reason for involuntarily disassociating Plaintiff from practice. A genuine issue of material fact exists as to whether Defendant had sufficient cause to involuntarily disassociate Plaintiff from practice. (CARTER and McDADE, concurring.)
