This case presents question as to whether trial court properly granted defendant’s motion for summary judgment in plaintiff’s personal injury claim that arose out of construction project, where defendant, as local public entity, asserted that it was entitled to immunity under section 2-201 of Tort Immunity Act, where instant construction contract authorized defendant to have discretionary supervision, but delegated means, method and safety of work to general contractor. Appellate Court, in reversing trial court, found that local public entity cannot claim section 2-201 immunity unless entity presents evidence of its decision-making process as to specific act or omission from which plaintiff’s injuries arose.
