Defendant was convicted, after bench trial, of delivery of a controlled substance and possession of a controlled substance with intent to deliver. Record shows that Defendant was not confused about his right to a jury and he understandingly waived that right. Court was not required to admonish him again before trial began 2 weeks later. Defendant was charged based on the amount of cocaine in 1 of the 9 baggies in his sock. The fact that he possessed 9 separate bags indicated that each was for sale, and Defendant admitted that he previously sold cocaine. Evidence was sufficient to prove that he possessed the cocaine with intent to deliver it. (BURKE and SPENCE, concurring.)
