(CUNNINGHAM and CONNORS, concurring.) Petitioner sought appoint of a special state's attorney "to determine whether criminal charges should be brought against any person in connection with the homicide of his son", who was shot by police officer in 2011. Officer stated that son had pulled a black object out of his pocket, which he believed was a gun (but which was actually a cell phone) and charged at him. Previous State's Attorney, and current State's Attorney, concluded that there was insufficient evidence to support criminal charges against officer. Petition does not describe any particular steps taken or not take by current State's Attorney; allegations are that she is unable to fairly investigate and prosecute any case of police misconduct. Statements made during her election campaign are insufficient to establish actual conflict of interest. Court properly denied petition as Petitioner failed to show that State's Attorney was unable to fulfill her duties under subsection 3-9008(a-5) of Counties Code, or that there was an actual conflict of interests under subsection 3-9008(a-10).
