Sexual Assault
(Court opinion corrected 4/9/19.) After a 2018 discharge hearing, Defendant was found not not guilty of aggravated criminal sexual assault on the basis of unfitness. Appellate court had previously held that Defendant was required to register pursuant to SORA (Sex Offender Registration Act). SORA is constitutional on its face and as applied to Defendant. SORA is rationally related to the legitimate state interest of protecting the public from sex offenders. In light of evidence as to Defendant's ability to complete tasks at work and to take care of his own personal matters such as paying bills and doing laundry), he was capable of complying with the registration requirements.
