Two provisions of Video Gaming Act are rationally related to a legitimate state interest and are thus constitutional: one that prohibits certain businesses involved in video gaming from being involved in multiple aspects of the industry, and another that requires the business that owns the gaming machine and the business where the machine is located to equally split after-tax profits from machine. Two counts related to Plaintiffs' challenge to the Illinois Gaming Board's policy documents on promotions are not moot, as a determination on procedures for posting the policy document could directly impact the rights and duties of the parties.(McBRIDE and GORDON, concurring.)
