Appellate court had previously remanded solely for imposition of a lesser discipline upon Plaintiff employee, an ecologist, than the 29-day suspension. Court then entered order reversing a July 11, 2018, order by the Employee Appeal Board which had suspended Plaintiff from employment for 15 days. Board’s action on remand, in imposing another suspension, exceeded the scope of the circuit court’s 2018 remand. However, circuit court’s 2019 order, which left Plaintiff with no discipline at all, contradicted both its own prior order and all the prior findings of the board and the ALJ. Reversed and remanded to the Board for imposition of discipline consistent with the circuit court’s 2018 order.(REYES and BURKE, concurring.)
