Illinois Appellate Court
Civil Court
Sanctions
In supplementary proceedings, judgment creditors sought to enforce a $250,000 judgment, and filed citation to discover assets against Defendant company’s president and sole shareholder. Court ordered Defendant to file sworn answer as to certain properties it owned. Company president submitted affidavit describing them, but never filed the affidavit himself. Plaintiffs filed motion for sanctions, claiming that affidavit contained false information. Court properly vacated prior judge’s order imposing sanctions against President, as Rule 137 only applies to pleadings and documents filed with the court. (FITZERGALD SMITH and COGHLAN, concurring.)
