The exclusivity provisions of the Workers' Compensation Act do not bar a claim for statutory, liquidated damages, damages under the Biometric Information Privacy Act where an employer is alleged to have violated an employee's statutory privacy rights under the Biometric Information Privacy Act. A claim under the Privacy Act is not the type of injury that fits within the purview of the Workers' Compensation Act. (DELORT and HOFFMAN, concurring.)
