Ineffective Assistance of Counsel
Defendant was convicted, after bench trial, of 1 count of armed habitual criminal (AHC) and 1 count of unlawful use of a weapon by a felon (UUWF). Defendant’s conviction for aggravated vehicular hijacking was for offense committed when he was 17, more than 10 years prior. Defendant failed to adequately allege that his trial and appellate counsel were deficient in failing to object to the use of the aggravated vehicular hijacking conviction to support the AHC conviction, given the state of the law at the time of his conviction and his direct appeal.
