Illinois Appellate Court
Civil Court
Unemployment Insurance Act
Defendants appealed circuit court’s reversal on administrative review of the Department of Employment Security Board of Review determination that plaintiff was ineligible for unemployment benefits. The appellate court reversed the judgment of the circuit court and reinstated the decision of the Board on the basis that the Board’s findings were not against the manifest weight of the evidence where employee's evidence was not credible and where she did not offer testimony from her treating phyisicans and, as a result, the employee had not proven she was physically and mentally capable of working as is required to receive benefits under the Unemployment Insurance Act.
