Pre-Trial Fairness Act
The Illinois Supreme Court reversed an order of the circuit court by finding that criminal justice reforms eliminating the use of cash bail do not violate the Illinois constitution. The circuit court had held that the changes to the statutory framework for pretrial release of criminal defendants violated the bail clause, the crime victims’ rights clause, and the separations of powers clause. A majority of the Supreme Court, with two justices dissenting, held that the Illinois Constitution does not mandate the use of monetary bail.
