Class Action Lawsuit
Plaintiffs appealed from the trial court’s dismissal of their class action lawsuit alleging that defendant violated Chicago’s Residential Landlord and Tenant Ordinance. Plaintiffs argued on appeal that the trial court erred in dismissing the complaint for lack of standing where they alleged that the defendant failed to provide them with the required information about current interest rates applicable to security deposits despite plaintiffs having never paid a security deposit. The appellate court affirmed the dismissal, finding that plaintiffs could not allege any injury. (MIKVA and NAVARRO, concurring)
