Defendant, who was arrested and detained prior to the effective date of the Pretrial Fairness Act, appealed from an order of the circuit court that reimposed monetary bail as a condition of the defendant’s pretrial release. The appellate court reversed and remanded, finding that the Act forbids the circuit court from reimposing monetary bond as a condition of pretrial release unless the defendant elects to stand on the original terms of his bond, which was set before the effective date of the Act.
