Pre-Trial Fairness Act
Defendant appealed from a trial court order denying him release pursuant to the Pre-Trial Fairness Act. On appeal, he argued that he was denied a fair hearing because the State relied on criminal history that it did not provide to the defense or file with the court. The appellate court reversed and remanded, agreeing that the State’s failure to tender the criminal history to the defense before the hearing warranted a new hearing.
