Illinois Appellate Court
Criminal Court
Pretrial Fairness Act
In consolidated appeals, defendant appealed from a trial court order granting the State’s petition to revoke or modify his pretrial release conditions. On appeal, the appellate court considered whether there was statutory authority to detain the defendant pending a hearing on the State’s petition to revoke probation. The appellate court vacated the trial court order and remanded for further proceedings, finding that there was no statutory authority to detain defendant pending a hearing on the State’s petition to revoke probation.
