Juror Misconduct
Defendant was found guilty of one count of criminal drug conspiracy and one count of racketeering and was sentenced to three concurrent life sentences for racketeering and a 40-year term for criminal drug conspiracy and defendant appealed. The appellate court granted defendant’s motion to sever his appeal from those of his co-defendants and then remanded the matter for further inquiry into allegations of juror misconduct and, if a new trial was not found to be necessary, re-sentencing on criminal drug conspiracy.
