In a case arising out of the installment purchase of a used automobile, plaintiff appealed from the trial court’s denial of its motion to compel arbitration. The appellate court affirmed, finding that the circuit court did not err in denying the motion to compel arbitration and properly found that a class action waiver contained in the retail installment contract between the parties only applied within the context of the arbitration agreement and explicitly waived rights to arbitrate a class action lawsuit.
