Defendant was found guilty of home invasion and aggravated criminal sexual assault and sentenced to 40 years in prison. On appeal, he argued that he was not proven guilty beyond a reasonable doubt of home invasion where the scene of the offense, the women’s bathroom on the floor of the university dormitory where the victim’s room was located, could not be found to be part of the victim’s “dwelling” for the purposes of the home invasion statute. The appellate court affirmed, finding that there was more than sufficient evidence upon which a rational trier of fact could find that the bathroom was a portion of the victim’s dwelling and that the defendant committed a home invasion.
