Phase I/Phase II: Implementation of the New ASTM Guidelines
On December 15, 2022, the U.S. Environmental Protection Agency adopted a Final Rule incorporating by reference the latest iteration of the American Society for Testing Materials (ASTM) Standard Practice for conducting Phase I Environmental Site Assessments. This new standard replaces the prior standard – and beginning February 13, 2024, only the new standard practice will satisfy the Final Rule. Coal Combustion Residuals: New Regulatory Developments and Practice Insights
Coal ash, a residual from coal combustion, is one of the largest types of industrial wastes generated in the United States and potentially has significant environmental impacts due to its contents of mercury, cadmium, and arsenic. To provide environmental protection from this contamination, the U.S. Environmental Protection Agency established national rules for coal ash disposal. This session examines these regulations, as well as the proposed changes for legacy coal combustion residuals surface impoundments, the issues with the management and disposal of coal combustion residuals, and how the rules are enforced.

Nutrient Loss Reduction in the Agricultural Sector: Method and Practice
The agriculture sector is the subject of significant attention on the nutrient loss reduction front. Implementation of nutrient loss reduction practices remains wholly voluntary. This segment examines the ongoing work with clients implementing these practices, which practices are most popular, and the outlook for further implementation. The legal and policy framework currently in place to encourage implementation is also explored.

Monitoring and Inspecting Environmental Conditions Remotely; Use of Scientific Evidence and Modeling in Litigation
The first half of this session addresses the evolving use of remote data collection and management in the context of several different environmental management markets. These markets include intended and unintended impacts of drone imagery on stormwater management compliance and SWPPP inspections, use of remote air monitoring for compliance at a superfund remedial action closure, and use of remote stormwater quality data and associated data management and analysis. This data could potentially be used in State and Federal enforcement litigation and private party tort litigation.

The Future of Energy in Illinois: Implementing the Climate and Equitable Jobs Act (CEJA)
Late in 2021, Governor Pritzer signed into law the Climate and Equitable Jobs Act (CEJA, P.A. 102-0662). This blockbuster law set ambitious renewable energy and decarbonization targets that are now being implemented in several important cases at the Illinois Commerce Commission. An Introduction to StormStore
The Illinois Chapter of The Nature Conservancy has partnered with the Metropolitan Planning Council (MPC), a Chicago-based planning and policy not-for-profit, to explore ways that green stormwater infrastructure can be incentivized in Cook County to deliver solutions to the most flood vulnerable communities. One option currently being piloted with Cook County’s local stormwater utility (MWRD) is stormwater credit trading, a concept that offers an alternative pathway for Cook County developers to comply with local stormwater management requirements by allowing use of offsite stormwater facilities. Through this pilot, TNC and MPC have identified some clear opportunities where stormwater credit trading can help bring new green stormwater infrastructure (GSI) to communities in need of it, as well as barriers to accelerating and advancing use of natural infrastructure solutions in Cook County.

PFAS Update for the Environmental Practitioner: What’s in Store for 2024?
PFAS continue to draw intensifying scrutiny from state and federal legislators, the news media, regulators, and public interest organizations. The U.S. EPA pushes ahead with efforts to research, restrict, and remediate PFAS through a suite of significant proposals slated for 2024, while the Illinois EPA continues to contemplate stringent PFAS groundwater standards. While regulatory efforts progress, plaintiffs’ firms have launched dozens of lawsuits targeting consumer products purported to contain PFAS. This session goes beyond “what are PFAS?” and offers an in-depth look at these and other recent developments, including the timing and significance of future regulation, remedial technologies, and implications for environmental due diligence.

Nutrient Requirements in Water Permits for Municipal Sources
According to the U.S. Environmental Protection Agency, discharges from municipal wastewater treatment facilities are a significant source of these nutrients to surface waters throughout the country. Setting permit requirements and treating the wastewater to meet specific effluent limits can reduce nitrogen and phosphorus loading from these facilities, but can also carry significant costs. This session focuses on the Clean Water Act and legal perspective relative to nutrient permit requirements for point sources. Topics include: the relevant caselaw that may impact your clients, the large number of Illinois dischargers that may be subject to these permit requirements, the potential for permit litigation, and the opportunity for collaboration on a watershed basis to address nutrient issues.

Bankruptcy and Environmental Issues
What does an attorney do when a client has an environmental problem, but no money to fix it? In other situations where the client has run out of money, the solution might be to file bankruptcy and start over; however, when the financial drain is caused by an environmental condition at the client’s property, a bankruptcy may not be an available solution.
