Plaintiffs filed a lawsuit challenging a state law prohibiting physicians from providing gender-affirming care, alleging that it deprived transgender individuals of the equal protection of the law, that it infringed on parents’ fundamental right to oversee their children’s medical care, and that it infringed on physicians’ speech. The district court entered a preliminary injunction and the state appealed. The Seventh Circuit reversed, vacated the preliminary injunction, and remanded, finding that entry of the preliminary injunction was not warranted because plaintiffs had not shown a likelihood of success on any of their claims and explaining that the courts have consistently deferred regulation of licensed professions to the legislature. While the Illinois Marriage and Dissolution Act concentrates on intact families who are undergoing a separation, the Illinois Parentage Act impacts all children regardless of parental separation, unmarried couples, and parents who were never couples. In a nutshell, the Illinois Parentage Act is the statute that deals with everyone.
