In a case involving a dispute under the Perishable Agricultural Commodities Act, a statute that regulates the market for fresh fruits and vegetables, plaintiff appealed from a district court order entering summary judgment in favor of the defendant in agreement with the Secretary of Agriculture’s ruling in a administrative proceedings that were initiated by the defendant. The Seventh Circuit affirmed, finding the district court did not commit reversible error in entering summary judgment for the defendant and that entry of summary judgment was supported by the facts and evidence before the court. The Seventh Circuit also found that the district court did not err when it denied plaintiff’s motion to conduct additional discovery after the motion was filed. (EASTERBROOK and RIPPLE, concurring)

Plaintiff, a grain producer, filed a claim with the Department of Agriculture after a licensed grain dealer failed to make payments under a price later contract it entered into with the plaintiff. The plaintiff and the department disagreed about the implementation of a delayed pricing contract as the pricing date determined whether the plaintiff was eligible for compensation from the Illinois Grain Insurance Fund. The supreme court agreed with the position of the department and concluded that because the plaintiff did not sign the contract for the sale of grain within 30 days of the completion of the grain delivery, the grain was priced on a date outside the protection window established by the Grain Code and, as a result, plaintiff was not eligible for compensation from the fund. Public Act 103-298

Topic: 
Illinois Radon Awareness Act

(Williams, D-Chicago; Ellman, D-Naperville) amends the Illinois Radon Awareness Act. It provides that the lessor shall provide the prospective tenant or tenant of a dwelling unit with the Illinois Emergency Management Agency’s “Radon Guide for Tenants” pamphlet, copies of any records or reports pertaining to radon concentrations within the dwelling unit that indicate a radon hazard to the tenant, and the new statutory Disclosure of Information on Radon Hazards to Tenants form. These must be provided at the time of a prospective tenant’s application to lease a dwelling unit, before a lease is entered into, or at any time during the leasing period upon request. Provides that at the commencement of the agreed leasing period, a tenant shall have 90 days to conduct his or her own radon test of the dwelling unit. Requires a tenant who decides to have radon mitigation performed to have the express consent of the lessor before doing so. Makes other changes. Effective Jan. 1, 2024.

House Bill 2098

Topic: 
Amends the Residential Real Property Disclosure Act

(Tarver, D-Chicago; Sims, D-Chicago) provides that "seller" does not include a beneficiary who has both (1) never occupied the residential real property and (2) never had management responsibility for the residential real property. Passed both chambers.
