This case presents question as to whether Farm Nuisance Act (Act) provides defendants-cattle farmers with immunity from plaintiffs' lawsuit alleging that defendant's cattle farm was nuisance due to excessive flies that emanated from said farm. Appellate Court found that although defendants had commenced farming operations prior to plaintiffs moving into vacant home, immunity conferred under Act did not apply since at time defendants had purchased their property individuals were living in nearby home on land eventually deeded to plaintiffs, and fact that plaintiffs subsequently demolished said home and built new home on same location did not cause defendant's cattle operation to become nuisance so as to trigger immunity provisions of said Act. Illinois Estate Tax
(Hutchinson, D-Chicago Heights; Bradley, D-Marion) changes the State tax credit of the Illinois Estate and Generation-Skipping Transfer Tax Act to be $2 million for persons dying before Jan. 1, 2012; $3.5 million for persons dying on or after Jan. 1, 2012 but before Jan. 1, 2013; and $4 million for persons dying on or after Jan. 1, 2013. It has passed both chambers as part of the CME/Sears tax package, and Governor Quinn has indicated that he will sign it.

Transfer on death instrument
(Bradley, D-Marion; Wilhelmi, D-Joliet) creates the Illinois Residential Real Property Transfer on Death Instrument Act. It allows an owner of real estate to transfer residential property on his or her death. The definition of "residential property" is borrowed from the Disclosure Act and the Mortgage Foreclosure Act. The act requires that the owner (1) sign in front of a notary and two credible witnesses and (2) have the same mental capacity to execute a TODI as is required to make a will. Effective January 1, 2012.
