Join us for a comprehensive look at how to increase the health and wellness of you and your colleagues with this informative presentation. Attorneys with all levels of practice experience who attend this onside program will better understand:
  • The interactive and complementary nature of programs offered by the Illinois Bar Foundation (IBF), the Lawyers’ Assistance Program (LAP) and the Attorney Registration & Disciplinary Commission (ARDC) to assist with mental health/substance abuse issues and wellness for Illinois attorneys;
  • The process for requesting services through LAP and IBF’s Lawyers Care Program; and
  • How a complaint that’s filed with the ARDC may lead to a referral for assistance from LAP and/or IBF.

Plaintiff filed a lawsuit alleging a breach of an insurance contract after the defendant insurance company denied plaintiff’s underinsured motorist claim on the grounds that he did not qualify as an insured under his employer’s commercial automobile insurance policy. The district court granted the defendant’s motion to dismiss for failure to state a claim and plaintiff appealed. The Seventh Circuit affirmed, finding that plaintiff, who was riding a bicycle, was not occupying a covered vehicle at the time of the accident and was not an insured for the purposes of liability coverage. Plaintiff filed a declaratory judgment action seeking a declaration that an insurance policy it issued to the defendant did not cover claims related to damage to the defendant’s property by vandals. The insurance company alleged that the property was vacant and, as a result, was not covered under the terms of the policy. Defendant counter-sued and alleged that plaintiff denied the claim in bad faith. The district court found that the hotel was vacant as a matter of law as a sanction against plaintiff for failing to comply with discovery and granted summary judgment in favor of the defendant. The Seventh Circuit affirmed, finding that the sanction was an appropriate, proportionate response and was not an abuse of discretion. (EASTERBROOK and KIRSCH, concurring)

In an insurance coverage matter, the court considered whether the defendant insurance company had a duty to defend and indemnify the plaintiff in a lawsuit bought by individuals alleging that they were harmed by electromagnetic field radiation coming from the plaintiff’s power transformers. The Seventh Circuit affirmed the district court’s grant of summary judgment in favor of the insurance company, explaining that a coverage exclusion of “any form of radiation” included the EMF radiation alleged in the underlying lawsuit. (RIPPLE and PRYOR, concurring)

The trial court granted the defendant’s motion to dismiss, finding that the complaint was untimely because it was filed after the contract’s one-year suit limitations period. The appellate court affirmed, finding that plaintiff was bound to the agreed-upon terms of the policy’s suit limitations provision. (McLAREN and HUTCHINSON, concurring)

In a declaratory judgment action, plaintiff appealed from a circuit court order granting summary judgment to the defendant which found that plaintiff was not entitled to additional insurance proceeds for incident-related losses and lost rental income stemming from a break-in that happened at plaintiff’s rental property that was insured by the defendant. Plaintiff argued on appeal that there was a genuine issue of material fact on the extent of actual damages plaintiff experienced as a result of the break-in, as well as reasonable repair costs, and whether defendant breached the terms of the insurance policy. The appellate court found no error and affirmed. (FITZGERALD SMITH and COBBS, concurring)

The appellate court affirmed, finding that the trial court correctly entered judgment in favor of the insurance company because it owed no indemnity obligation for the settlement of the underlying lawsuit where the insured was not “legally obligated” to pay anything under the terms of the settlement.
