Two plaintiff’s brought a lawsuit accusing their former professor of abuse. A third plaintiff alleged that the defendant wrongfully retaliated against him. After a trial, the jury found in favor of the defendant on all issues and awarded him damages against the plaintiffs who alleged abuse. Plaintiffs appealed, arguing that the trial court erred in denying their motions for summary judgment on the issue of defendant’s counter-claim for intentional infliction of emotional distress. The appellate court reversed the district court’s denial of one of the plaintiff’s motions for summary judgment and affirmed the trial court’s denial of a co-plaintiff’s motion for summary judgment and the denial of appellant’s motion for a new trial.
