Equitable Adoption in Illinois: Lessons From Hegner By Richard Kuhn & Melodee Wines Trusts and Estates, October 2026 Since the Illinois Supreme Court recognized equitable adoption in DeHart v. DeHart, the doctrine has received little appellate attention. The First District recently addressed the issue in In re Estate of Hegner, reaffirming DeHart's narrow framework and highlighting the significant evidentiary and procedural hurdles petitioners face.
