Legislation

The Section Council reviewed 39 bills that may affect their members’ practice area. Highlights of the most recent legislative session include:

  • House Bill 25 amends the Cannabis Regulation and Tax Act to raise specified square footage requirements for craft growers.
  • House Bill 1205 amends the Cannabis Control Act to provide that, in calculating the weight of cannabis for the purpose of imposing a penalty against an individual, the weight of the amount of cannabis that may be legally possessed shall be subtracted from the total weight used in determining the offense class or applicable fine. If a motor vehicle is driven or occupied by an individual 21 years of age or over, a law enforcement officer may not search or inspect the motor vehicle, its contents, the driver, or the passenger solely because a law enforcement officer or a police dog trained in the detection of cannabis smelled that cannabis is present in the private motor vehicle.
  • Senate Bill 2321 amends the Right to Privacy in the Workplace Act to provide that an employer may not refuse to hire an individual or discipline an employee because results of an individual's drug test indicate the presence of THC.
