Legislation
The Section Council reviewed 101 bills that may affect their members’ practice area. Highlights of the most recent legislative session include:
- House Bill 4738 amends the Home Repair and Remodeling Act to provide that a contractor offering home repair or remodeling services shall not propose to contract or solicit a contract for home repair or remodeling services: (1) while a loss-producing occurrence is continuing at the premises; (2) while the fire department or emergency personnel are engaged at the damaged premises; or (3) between the hours of 7:00 p.m. and 8:00 a.m. Provides that a contractor shall not, in person, propose to contract or solicit a contract with a consumer for home repair or remodeling services for a minimum of 72 hours after a disaster proclamation, unless the proposal to contract or the solicitation to contract is initiated by a consumer.
- Senate Bill 3401 amends the Common Interest Community Association Act to require a common interest association to conduct and update a reserve study every 5 years.
- Senate Bill 3514 amends the Capital Development Board Act to provide that the Capital Development Board may enter into contracts and manage construction projects pursuant to a public-private partnership agreement on behalf of an institution of higher education or a State agency, excluding the Department of Corrections, if the State agency or institution of higher education is authorized by statute or otherwise permitted to enter into a public-private partnership agreement.
