Legislation
The Section Council reviewed 265 bills that may affect their members’ practice area. Highlights of the most recent legislative session include:
- House Bill 4327 is known as the "340B Transparency, Reporting, and Accountability Act." The bill aims to enhance the transparency and accountability of the 340B Drug Discount Program in Illinois by establishing a framework for reporting and evaluating how 340B covered entities utilize the program.
- Senate Bill 3398 amends the Health Care Surrogate Act to clarify the rights of health care surrogates when a patient lacks decisional capacity The bill contains protections for both surrogates and health care providers and includes provisions for providing written information to surrogates, ensuring access to medical records, outlining surrogate replacement processes, and clarifying liability protections. The Act takes effect upon becoming law.
- Senate Bill 3365 amends the Medicare-Medicaid Alignment Initiative (MMAI) Nursing Home Residents' Managed Care Rights Law to apply to fully integrated dual eligible special needs plans and any managed care plan for individuals dually eligible for Medicare and Medicaid.
